The OIN license agreement provides for community members to limit the scope of their OIN cross-license commitment by taking a “Limitation Election” as described in Section 2.2.

However, there are ongoing commitments from an organization which takes a “Limitation Election.”  For example, the electee must provide a continuing license to all organizations which are OIN licensees at the time of the “Limitation Election” based on the Linux System at that time.  Because of these continuing commitments, organizations which have taken a “Limitation Election” are included in the list of OIN community members.  Please see the Notes below for more information.  

Note (1): Aeris Communications, Inc. exercised a Limitation Election under section 2.2 of the License Agreement on January 8, 2018.

Note (2): DRMetrix LLC provided written notice on October 8, 2021 of a change of control under section 2.3 of the License Agreement. DRMetrix LLC indicated that such change of control was effective as of October 8, 2021.

Note (3): Geeknet exercised a Limitation Election under section 2.2 of the License Agreement on November 30, 2012.

Note (4): Gen Digital Inc. (formerly Symantec/NortonLifeLock and Avast/AVG). Symantec Corp exercised a Limitation Election under section 2.2 of the License Agreement on October 8, 2013. Under the terms of the OIN license, Norton LifeLock’s (formerly Symantec) 2022 acquisition of Avast/AVG (Avast is an OIN licensee by virtue of AVG’s execution of the OIN license in 2015) resulted in Gen Digital (new name of NortonLifeLock and Avast/AVG) assuming the OIN license obligation through acquisition.

Note (5): Hewlett-Packard Company exercised a Limitation Election under section 2.2 of the License Agreement on August 8, 2013.

Note (6): Nginx, Inc. provided written notice on March 28, 2019 of a change of control under section 2.3 of the License Agreement. Nginx, Inc. indicated that such change of control was effective as of March 9, 2019.

Note (7): NXP Semiconductors N.V. (NXPI) exercised a Limitation Election under section 2.2 of the License Agreement on December 1, 2016.

Note (8): Oracle exercised a Limitation Election under section 2.2 of the License Agreement on March 29, 2012.

Note (9): Orbital ATK exercised a Limitation Election under section 2.2 of the License Agreement on March 29, 2018.

Note (10): Scientific Games exercised a Limitation Election under section 2.2 of the License Agreement on February 1, 2019.

Note (11): Slock.it exercised a Limitation Election under section 2.2 of the License Agreement on April 10, 2019.

Note (A): Open Invention Network periodically screens its community members against applicable restricted party lists to ensure ongoing compliance with applicable law. As a result, OIN has become aware that two of its community members are the subject of economic sanctions imposed by certain jurisdictions. These entities were not sanctioned parties at the time they signed the OIN License Agreement. Specifically:

  • KNS Group LLC, d/b/a Yadro was added to the U.S. List of Specially Designated Nationals and Blocked Persons (“SDN List”) in February 2023.
  • Synesis was added to the SDN List in February 2022. Synesis is also subject to economic sanctions imposed by the European Union, EU member states, and United Kingdom.

OIN is committed to complying with all relevant laws and regulations, including economic sanctions. OIN will not deal in any property or interest in property of an SDN, will block any property or property interest in which an SDN holds an interest, and will not recognize any actions or effectuate any transactions based on the exercise of rights by an SDN pursuant to the OIN License Agreement while the SDN entity remains designated on the SDN List.
