Proposed USPTO Restrictions - A Looming Threat to Businesses
In August, the United States Patent & Trademark Office (USPTO) opened the floodgates to public input on proposed Patent Trial & Appeal Board (PTAB) changes. More than 95% of all public comments—and nearly 85% of unique comments—opposed the proposals, according to analysis by Unified Patents. These changes, if greenlit, would overstep their authority, defy the America Invents Act (AIA), wreak havoc on the economy, and fuel a surge in Patent Assertion Entity (PAE) litigation.
This issue has ignited Open Source stakeholders and the media. If the USPTO's changes gain traction, they will usher in an era of Patent Aggression Entities — commonly known as patent trolls — setting their sights on Small- and Medium-Sized Businesses (SMBEs). The repercussions? A tangled web of negative outcomes, including questions of patent validity, that could rock the business landscape.
