Banks & Financial Institutions are Turning Away from Patent Suits & Discovering the Power of Patent Protection with OIN
After PNC was ordered to pay $218 million for infringing on USAA’s mobile check deposit patents in May 2022, it asked the U.S. Patent Office (USPO) to review the patents’ validity.

Effect of an open patent pool strategy on technology innovation in terms of creating shared value
A recent study, “Effect of an open patent pool strategy on technology innovation in terms of creating shared value,” demonstrates empirically that organizations which participate in OIN are more innovative.
The abstract states: “In open patent pools (OPPs), members share their patents to each other. What gains do they expect by sharing patents? In this study, we analyze the effects of an OPP strategy on technological performance in terms of creating shared value (CSV). A panel regression was performed to compare the technological performance of firms in Open Invention Network (OIN), which is a Linux industry OPP, to those of non-OIN firms using their patent data.
"Our results demonstrate that the leading groups in the OIN achieved innovation by having more patent applications, forward citations, and collaborative activities than non-participants. Furthermore, OIN firms play a more significant role in promoting knowledge spillovers than non-participants. We demonstrate the positive effects of an OPP strategy on innovation by empirically measuring the technological performance of CSV.”

Big news from Apple! The company — which has historically only developed proprietary technologies — is expecting to launch a mixed Augmented Reality/Virtual Reality (AR/VR) headset sometime this year that will run on Open Source.
The company is currently referencing the platform as realityOS but has referenced several potential names. Apple has published the source code for developers on GitHub.
WSOU Investments — also known as Brazos Licensing and Development & a Patent Assertion Entity (PAE) which has historically been active with litigation — intentionally chose the U.S. Western District of Texas Court when it sued Dell, EMC and VMware because it tends to be pro-patent, ruling in favor of plaintiffs. This time was a different story.
Judge Albright tossed out the case. This is significant because the Waco Division Federal Court keeps the busiest patent docket in the U.S. & Judge Albright has presided over 19% of all U.S. patent cases since 2021.
There has been an uptick in the number of motions — specifically those to dismiss under Federal Rule of Civil Procedure 12 on patent eligibility — since the Supreme Court’s Alice decision. For example, in Hawk vs. Castle a Federal Circuit panel rejected Hawk’s bid to revive its patent. The case proves Alice continues to have an impact on addressing invalid patents.Read More [+]
