Patent Wars Are Skyrocketing
With billions of investment capital at stake in the increasingly crowded field of Fintech, many speculate patent wars could be on the horizon.
If your company is in Financial Services, it could be at increased patent risk. New research shows Open Source-related patent assertions against Banks and Financial Services increased 100% between 2020 and 2021.

A recent policy change on a popular software license was caused by patent issues and should be considered by all Open Source projects.
Fedora no longer allows the use of the Creative Commons CC0 license for code. Richard Fontana of Red Hat says, “The reason for the change: Over a long period of time a consensus has been building in FOSS licenses that preclude any form of patent licensing or patent forbearance cannot be considered FOSS.”
The number of patent threats against the Financial Services & Banking industries is skyrocketing, but so is the number of patent assets among these companies as they invest in Artificial Intelligence (AI) technologies — many of which are based on Open Source.
U.S. Senator Thom Tillis has filed patent reform legislation.
“The Patent Eligibility Restoration Act of 2022” could effectively overturn Supreme Court precedents set in the Alice, Mayo & Myriad decisions. The U.S. Patent and Trademark Office (USPTO), Patent Trial and Appeal Board (PTAB), U.S. District Courts and the U.S. International Trade Commission (USITC) would determine eligibility and exclusions under the bill’s provisions.
Tillis’s intent is to restore patent eligibility to inventions in many fields, but also to resolve legitimate concerns over the patenting of “mere ideas, the mere discovery of what already exists in nature and social cultural content that everyone agrees is beyond the scope of the patent system.”
